08-09-1996 Special Meetingcc ~ ,~ BOON ~U ~.. 1~~.?~ SPECIAL MEETING OF THE ISLE OF WIGHT COUNTY BOARD OF SUPERVISORS HELD THE NINTH DAY OF AUGUST IN THE YEAR NINETEEN. HUNDRED NINETY SIX PRESENT: Phillip A. Bradshaw, Chairman Henry. H. Bradby, Vice Chairman O. A. Spady Robert C. Claud, Sr. Malcolm T. Cofer Also Attending: H. Woodrow Crook, Jr., County Attorney W. Douglas Caskey, County Administrator Carey H. Mills, Assistant Clerk Chairman Bradshaw called the meeting to order at 11:30 a.m. // County Attorney Crook circulated a written waiver of the requirement of five days' notice pursuant to Section 15.1-538 of the State Code which was signed by all five members of the Board of Supervisors and the County Attorney and made a part of the minutes as follows: We the five members of the Board of Supervisors and the County Attorney do hereby waive the five (5) days' notice requirements of Section 15.1-538 of the Code of Virginia for this special meeting of said Board called by members Phillip A. Bradshaw and Malcolm T. Cofer in writing on August 8, 1996. County Attorney Crook requested the Board enter executive session under Section 2.1-344 A7 of the Freedom of .Information Act for advice of counsel relative to potential litigation. At 11:35 a.m., Supervisor Spady moved the Board enter executive session for the reason stated by the County Attorney. The motion was adopted unanimously (5-0). At 12:40 p.m., upon returning to. open session, Supervisor Spady moved the Board adopt the following resolution: CERTIFICATION OF EXECUTIVE MEETING WHEREAS, the Board of Supervisors has .convened an executive meeting on this date .pursuant to an affirmative recorded vote and in accordance with the provisions of-the Virginia Freedom of Information Act; and, WHEREAS, 2.1-344.1A of the Code of Virginia requires a certification by this Board of Supervisors that such executive meeting was. conducted in conformity. with Virginia law; NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors 1 d 1 80QK 16 "".`~~c~ hereby certifies that, to the best of each .member's knowledge, (i) only. public business matters lawfully exempted from open meeting requirements by Virginia law were discussed in the executive meeting to which this certification resolution applies,. and (ii) only such public business matters as were identified in the motion convening the executive meeting were heard, discussed or considered by the Board of Supervisors. VOTE AYES: 5 . NAYS: 0 ABSENT DURING VOTE: 0 ABSENT DURING MEETING: 0 The motion was adopted. unanimously (5-0). Supervisor Spady moved the Board. direct the County Administrator to attempt to set a meeting of the committee of the County and the committee of the Town of .Smithfield to continue to negotiate concerning the proposed annexation.
