REGULAR MEETING OF THE ISLE OF WIGHT COUNTY BOARD OF SUPERVISORS
HELD THE FIRST DAY OF NOVEMBER IN THE YEAR NINETEEN HUNDRED NINETY

Chairman Bradby called the meeting to order at 2:00 P.M. The
invocation was delivered by Supervisor Ross.

Chairman Bradby called for Transportation Matters..
MacFarl-and Neblett, Resident Engineer, Virginia Department of
Transportation, appeared and stated Orchard Garden Lane (Route
1403) is now officially in the system with rock placed in the worse
areas to fill the holes. Mr. Neblett reported that due to
shortfalls, the Virginia Department of Transportation was looking
at reducing maintenance activities with regard to ditch cleaning
and mowing; however, surface areas of the roads would continue to
be maintained and the County may see construction projects delayed
by a three to four months period. as they come up for advertisement..
Chairman Bradby called for comments by the .Board.
Supervisor Bradshaw stated Route .6.47 may require .widening.
Mr. Neblett stated he would look into the matter.
Supervisor. Edwards asked if the Virginia Department of
Transportation was finished with installing the highway. signs on
the secondary roads.
Mr. Neblett replied this had not been fully accomplished yet,
but he hoped to get this completed within the near future.
Supervisor Bradshaw asked the status of the connector at the
bypass at Route 258.
Mr. Neblett replied that although it was tentative, he had met
with officials of Franklin Equipment Company and was looking at~a
location .following the existing Route 16.03 which would tie into
Route 260 as it was built.
Chairman Bradby called for comments•by citizens.
Paul- Wilson of Longview expressed concern about the
intersection where Highway 600 crosses Route 10, one half mile
north of Chuckatuck. Mr. Wilson stated there was a turn lane for
traffic southbound to Chuckatuck to Cherry Grove Road, but there
was no turn lane to turn west on Oliver Drive.
Mr. Neblett stated he would have the traffic safety personnel
look into it.
Mr. Wilson stated he would like to see a speed limit
established of 45 mph at the intersection.
Mr. Neblett stated he would conduct a speed study.
Mr. Wilson questioned when the work would begin to straighten

the curves on Oliver Drive..
Mr. Neblett stated this project may be influenced by the
current budget constraints.

Chairman Bradby called for a public hearing on the following
applications .
The application of Ralph A. Godwin, Jr., owner and
Richard J. and Carey H. Mills, prospective owners for a
change in zoning classification from A-1, Agricultural
Limited to Conditional R-1, Conditional Rural
Residential, 5.525 acres of land located on the north.
side of Route 652, between Route 258 and the intersection
of Routes 692 and Route 652, in Newport Magisterial
District. The purpose of the application is for one (1)
rural residential lot.
Chairman. Bradby called for citizens to speak in favor.
Carey. H. Mills, prospective owner, appeared.
Chairman Bradby called for citizens to speak in oppositions

Chairman Bradby called for comments by Board members.
Supervisor Turner moved the Board approve the application of
Ralph A. Godwin, Jr., owner and Richard J. and Carey H. Mills,
prospective owners. The motion passed by unanimous vote (5-O).
Chairman Bradby called for a public hearing on the following
application:
The application of Phillip N. Davis, Jr., owner and The
Laurels Partnership, prospective owner for a change in
zoning classification from A-1, Agricultural Limited and
A-2, Agricultural General to Conditional B-1, Conditional
Business General, approximately 17.5 acres of .land
located on the east and west sides of Route 1T, between
Route 661 and the Chuckatuck Creek,. in Newport
Magisterial District. The purpose of the application is
for uses as conditioned by the applicant..
Chairman Bradby called for citizens to speak in favor..
William Riddick, .attorney representing the applicants,
appeared stating that the applicants are providing proffered
conditions. and feel the location is an outstanding site for
commercial development and growth.
Chairman Bradby called for citizens to speak in opposition.
William Huskey appeared stating that he had not been contacted
with regard to the application. Mr. Huskey continued he would hate
to see anything put in .the orchard, especially if it would drain
into his property.
Chairman Bradby called for comments by the Board.
Supervisor Turner asked Mr. Riddick for a response in regard
to Mr. HuskBy's comments about the drainage.
Mr. Riddick replied that the northwest and southwest side of
the property totaled 3.5 acres with a large buffer zone consisting
of approximately 11.5 acres and that the applicant is responsible
for dealing with whatever drainage problems may exist.

Supervisor Turner stated he had a letter from Mr. Reynolds
opposing the rezoning application.
Supervisor. Bradshaw moved the Board approve the application
of Phillip N. Davis, Jr., owner and The Laurels. Partnership,
prospective owner. The motion passed by unanimous vote (5-0).
Chairman Bradby called for a public hearing on the following
application:
The application of James W. and Pearl B, Jones for a
change in zoning classification from A-l, Agricultural
Limited to Conditional R-A, Conditional Rural
Residential, approximately eight (8) acres of land
located on the south side of Route 648; between Route 614
and Route 641, in Windsor Magisterial District. The
purpose of the application is for no more than eight (8)
single family rural residential lots..
Chairman Bradby called for citizens to speak in favor.
Judy Whitley, realtor, appeared on behalf. of James W. Jones
to have eight (8) lots rezoned on Highway 648.
Chairman Bradby called for citizens to speak in opposition.
No one appeared.
Chairman Bradby called-for comments by Board members
Supervisor Bradby moved the Board approve the application of
James W. and Pearl B. Jones. The :motion passed by unanimous vote
(5-0).
Chairman Bradby called for a public hearing on the following:
Resolution to Exempt Smithfield Little Theatre, Inc. from
Property Taxation
Chairman Bradby called for citizens to speak in favor,
E. Brian Pritchard, member of the Board of Directors of the
.Smithfield Little Theatre, appeared stating it was a non-profit
organization which provides a service to the community.
Chairman Bradby called for citizens to speak in opposition,
No one appeared.
Chairman Bradby called for comments by Board members.
Supervisor Turner moved the Board adopt the following
resolution: i
RESOLUTION TO EXEMPT
SMITHFIELD LITTLE THEATRE, INC.
FROM PROPERTY TAXATION
WHEREAS, Article X, Section 6, of the Constitution of
Virginia, provides that the General Assembly may exempt from
taxation property used by its owner for religious, charitable,
patriotic, historical, benevolent., cultural or public park and
playground purposes; and,
WHEREAS, the General Assembly of Virginia has provided by an
Act embodied in Section 30-19.04 of the Code of Virginia procedure
to be followed by the General Assembly in the designation of
property to be exempted from taxation pursuant to Article X,
Section 6, of the Constitution of Virginia, which requires a

resolution from the governing body of the County wherein such
:property is situated adopted after public hearing and consideration
. of certain factors; and,
WHEREAS, Smithfield Little .Theatre, Inc. of the Town of
Smithfield, County of Isle of Wight, Virginia, has requested the
Board of .Supervisors of the County of Isle of Wight, Virginia, that
such a resolution be adopted to exempt the property of Smithfield
Little Theatre, Inc., located in said County from property-
taxation; and,
WHEREAS, the Board of Supervisors of Isle of Wight County,.
Virginia, has considered (i) that Smithfield Little Theatre, Inc.
is exempt. from taxation pursuant to Section 501(c) of the
International Revenue Code of 1954; (2) that the Smithfield Little
Theatre, Inc. does not serve alcoholic beverages and is'not
licensed by the Alcoholic Beverage Control Board to serve alcoholic
beverages on such property; (3) that no director or officer of the
organization is paid compensation for personal services which such
director or officer actually renders; (4) that no part of the net
earnings of the organization inures. to the benefit of any
individual; (5) that a significant portion of the service provided
by such organization is generated by funds received from donations
and contributions; (6) that the organization does provide services
for the common good of the public; (7) that no part ~f the
activities of the organization involves carrying on propaganda or
otherwise attempting to influence legislation and said organization
does not participate in or intervene in any political campaign on
behalf of any kind of public office; and (8j no rule or regulation
policy or practice of the organization discriminates on the basis
of religious conviction, race, color, sex or national origin; and,
WHEREAS, said resolution was duly advertised in a newspaper
published in the County of Isle of Wight and a public hearing held
thereon seven days after the notice was published and no one
appeared at the public hearing to oppose said resolution in the
granting of exemption from taxation for said organization.
NQW, THEREFORE, BE IT AND IT I5 HEREBY RESOLVED by the Board
of Supervisors of Isle of Wight County, Virginia, that the General
Assembly of Virginia give favorable consideration to the granting ~
of exemption from taxation pursuant to Article X, Section 6, of the !
Constitution of Virginia to the Smithfield Little Theatre, Inc. as
a cultural organization.
And the Clerk of this Board is directed to forward certified
copies. of this resolution to Honorable J. Paul Councill, Jr.,
Delegate, and Honorable Richard J. Holland, Senator, and to the
Chairman of the Committee of the General Assembly for the
consideration of legislation involved in the designation of
property to be exempted from taxation.,.
The motion to adopt said resolution passed by unanimous vote
(5-0).
Chairman Bradby called for a public hearing on the following:
Resolution Naming Private Streets
W. Douglas Casket', Assistant County Administrator/Community.
Development, appeared stating that the Board requested the .County
Attorney at the October 4, 1990 meeting to advertise a resolution ~
for the naming. of private streets. in Isle of Wight County which is
an effort in conjunction. with. the enhanced 911 emergency response
system..
County Attorney Crook asked Mr. Casket' where there were
streets with the same names in the proposed list of private street
names.

Mr. Caskey replied that there were streets with duplicate
names; however, the consultant indicated this would not present a
problem for the 911 emergency response. system...
Chairman Bradby called for citizens to speak in favor.
George Winslow, Carrollton, appeared stating he had a concern
with streets with duplicate names. because this could cause a
problem with mail and individuals trying to locate homes.
Mr. Caskey replied that the addresses coded for the County are
established on a grid system which runs north to south and that the
consultant has indicated that as long as there is reasonable
separation between any duplicate streets, the addresses will be
significantly different.
David Potts stated Miller Lane was changed to Candy Island
Lane and he and others wanted the fifty foot section to remain
Miller Lane with the remaining section to the left named Candy
Island Lane.
Horace Johnson appeared stating the straight portion of the
road was named Miller Lane, but he and others wanted the entire
lane coming in to be named Candy Island Lane..
Evelyn Fox appeared stating she wanted the road named Miller
Lane.
Supervisor Turner moved that the Board adopt the following
resolution excluding Candy Island Lane and Miller Lane which will
be discussed at the November 15, 1990 meeting:
RESOLUTION TO NAME PRIVATE STREETS
IN ISLE OF WIGHT .COUNTY
WHEREAS, the General Assembly for the Commonwealth of Virginia
by Act of the General Assembly as provided in Section 15.1-379 of
the Code of Virginia, has given the County governing body the
authority to name streets within. the County by resolution duly
adopted; and,
WHEREAS, the Board of Supervisors of Isle of Wight County has
heretofore adopted an ordinance to provide standards for naming
streets, fabrication, erection and maintenance of street names
signs and to establish a street address numbering system; and,
WHEREAS, the Planning Commission of ,Isle of Wight County after
public hearing, research and study, has recommended a list of
street names for the private streets of the County of Isle of
Wight, Virginia; and,
WHEREAS, the Board of Supervisors has held a public hearing
in the County of Isle of Wight to consider said street names and
other public comments and has duly considered all of same including
the advantages to be gained by the citizens of .Isle of Wight County
for police protection, fire protection and to facilitate location
of individuals within the County.
NOW, THEREFORE, be it and it is hereby resolved by the Board
of Supervisors of Isle of Wight County, Virginia., that the
following private streets be and are hereby given the names as
hereinbelow designated and attached hereto.

Chairman Bradby called for a public hearing on the following
ordinance:
Proposed Chesapeake Bay Preservation Area Ordinance and
Map Delineating Chesapeake Bay Preservation Areas in Ssle
of Wight County
W. Douglas Caskey, Assistant County Administrator/Community
Development, stated the General Assembly adopted the Chesapeake Bay
Preservation Act in April of 1988 which mandated that localities

within the Tidewater. Region of the Commonwealth develop local
ordinances and plans to support the land use regulations for
protection of the-water quality of the .Chesapeake Bay.
Ronald Bryan David, Environmental Planner for Isle of Wight
County, stated the proposed Chesapeake Bay Preservation Area
Ordinance has a jurisdiction of the entire. watershed which borders,
half of the County and the proposed program would cover the entire
watershed with the preservation area being composed of two sub-
areas; a resource protection area and a resource management area.
Mr. David continued the resource protection area includes tidal and
non-tidal that are connected by surface flow and contiguous to
tributary streams or tidal wetlands, tidal shores, and also a
component of the Resource Protection .Areas is a. 100 feet wide
vegetated. buffer area landward of the sensitive features. Mr.
David stated the second subcomponent of the preservation area is
a Resource Management Area consisting of flood plains, highly
erodible soils, highly permeable soils, steep slopes and all. other
lands that are not designated as resource protection areas. Mr.
David stated the next part of .the ordinance deals with vested
rights which consists of valid permits which have-been issued by
the Department of Community Development, as well as, lands or lots
that were legally subdivided before the adoption of the ordinance,
as well as, lots or parcels that were recorded prior to October 1,
1989 which have a limited vested right in that they have to comply
with the, County's ordinance to the maximum extent possible. Mr.
David continued there. are general development standards for all
activities within. the Chesapeake Bay Preservation Area which.
concern erosion and sediment controls for any type of land
disturbance which is over 2,500 square feet, storm water management
for quality. and quantity, 100$ reserve drainfield besides the
primary drainfield and all development would be required to go
through a plan of development review process through the Department
of Community Development. Mr. David stated the specific
develapment standards for activities within the resource management
area deal with limiting impervious ground cover and preserving
indigenous vegetation to the maximum extent possible and dealing
.with the water quality of the Chesapeake Bay and James River. Mr.
David stated there are specific development standards for
activities within the resource .protection areas which are more
restrictive in .that.. the only type of development that can occur is
a water dependent use or redevelopment of an existing use. Mr.
David continued the next general pravision is the water quality
impact assessment of which there are two types; minor, which deals
with development that disturbs less -than 10,000 square feet and.
.major. Mr. David stated the next general provision deals with
persons applying. or proposing any type of development requesting
an exception. Mr. David continued the ordinance does provide
authority within the Department of Community Development to work
out any type of problems in an application in that. if an applicant
.feels they may not have received a satisfactory resolution
decision, then .the decision may be appealed to the Planning
Commission. Mr. David stated if the conflict is still unresolved,
the person may appeal the Planning Commission's decision to the
Board of Supervisors. Mr. David stated the last provision deals
with performance guarantees in that all site plan approvals, the
applicant will have to execute a performance agreement stating the
applicant will carry forth everything indicated in-the site plan.
Mr. David stated the Department of Community has a discretion in
requiring a performance surety to ensure compliance.
County Attorney Crook asked why the ordinance provides for an
appeal to the Planning Commission..
Mr. David stated this process was the best way to develop the
ordinance because appeals from the zoning ordinance go to the Board
of Zoning Appeals.
County Attorney Crook asked if the ordinance was going to be
part of the zoning ordinance.

Mr. David replied the zoning ordinance is presently being
drafted and at this time it would be a stand-alone ordinance.
County Attorney Crook advised that the Planning Commission
does not make decisions that. stand alone and with this ordinance,
persons can appeal to the Planning Commission who would be making
decisions that would be a binding decision if not appealed to the
Board of Supervisors and that he did not think this was within the
purview of the Planning Commission's authority or responsibilities.
Mr. Crook continued that if it was appealed to the Board of
Supervisors with a hearing before the Planning Commission with a
recommendation of the Planning. Commission with the. Board of
Supervisors making the .decision it would be more legally sound
rather .than appealing to the Planning Commission.
Mr. David replied: that in developing the process of appeals
they were acting. on the State's advice who was in consultation with
the Attorney General, but he would not have a problem with hearings
before the Planning Commission with their recommendation to the
Board of supervisors who would initiate a final decision.
Chairman Bradby called for comments by citizens.
George Winslow of Carrollton and the Planning Commission
appeared stating he was in favor of having the Chesapeake
Preservation Act implemented in Isle of Wight County; however, the
Resource Management Area-is something the Board establishes and in
the Comprehensive Plan .development service districts have been.
established. Mr. Winslow suggested that the Board consider
defining the Resource Management Areas as being the development
service districts and have the .Resource Management. Areas be a
certain. set back distance from the Resource Protection Areas and
that the Board should review the ordinance more closely.
Supervisor Edwards moved the Board table the proposed
Chesapeake Bay Preservation Area Ordinance and Map Delineating the
Chesapeake Bay Preservation Areas in Isle of Wight County to the
November 15, 1990 meeting of the Board of Supervisors. The motion
passed by unanimous vote (5-O).

Grace Keen, Newport District, stated she was concerned about

Island and suggested that instead of closing the reserve
temporarily that it be closed only in the evening and open it in

Supervisor Turner moved the Board approve. the application of "
Charles H. Johnson, III and Contel Cellular of Norfolk, Inc. The

W. Douglas Caskey, Assistant County Administrator/Community
Development, stated that at the September 20, 1990 meeting a
proposed user fee schedule was presented as information and the
Board directed that the proposed user fee be forwarded to the
Planning Commission for their review and comment. Mr. Caskey
reported that the Planning Commission unanimously recommended
support for increased user fees which are representative of cost
recovery.
.Supervisor Ross moved the Board authorize County staff to
advertise the proposed user fee schedule for a public hearing. The
motion passed by unanimous vote (5-0).
W. Douglas Caskey, Assistant County Administrator/Community
Development presented a brief update on the status of Myers Landing
Subdivision stating it was a nine lot subdivision served by a small
road which will eventually be in the Virginia Department of
Transportation's secondary road system.. Mr. Caskey continued the
subdivision was located off Route 10 in the Rushmere area and since
the last briefing to the Board on July 5, 1990, the Virginia
Department of Transportation made an inspection and found a problem
with one of the drainage ditches serving the subdivision.. Mr.
Caskey stated that based on the Virginia Department of
Transportation's findings, there appears to be a considerable
amount of .work being recommended to the developer for correcting
the problem.
MacFarland Neblett, Resident Engineer, Virginia Department of
Transportation, stated the site was reviewed on October 12, 1990
and when he met with the developer, he presented two
recommendations:. first that the developer follow the originally
proposed drainage easement with a storm water detention pond to
retain the water and let it out slowly and secondly to install
approximately 200 feet of eighteen inch corrugated metal pipe in
the deepest section.
Supervisor Ross moved the Board authorize a letter be sent
informing Mr. Myers, the developer, that he had thirty days to
conform to the Virginia Department of Transportation's
recommendation. The motion .passed by unanimous vote (5-0).
W. Douglas Caskey, Assistant County Administrator/Community
Development stated he received a request from Mr. and-Mrs. William
Wood concerning waiving a fee for processing an application for a
conditional use permit. for a temporary mobile home due to a fire
which occurred over the weekend.
County Attorney Grook stated that if the persons were. not
indigent he did not think it would be proper for the Board to waive
the fee. County Attorney Crook stated that the procedure could
continue with the fee being paid later if the people were not
indigent.

WHEREAS, Mrs.. James C. Sprigg, Jr. has most graciously given
a contribution to expand and enhance the Isle of Wight County
Museum in memory of Mr. James C. Sprigg, Jr.; and,
WHEREAS, the funds in the amount of fifty thousand dollars
received from Mrs. James C. Sprigg, Jr. need to be appropriated to
the Recreational Facilities Authority, Museum Improvements line.

NOW, THEREFORE, BE IT AND IT IS HEREBY RESOLVED by the Board

Supervisor Edwards moved the Board adopt the following
resolution:
RESOLUTION. OF THE BOARD OF SUPERVISORS
OF ISLE OF WIGHT COUNTY
RECOGNIZING NOVEMBER AS ADOPTION MONTH
WHEREAS, finding permanent homes for waiting children. is_ a
pressing problem in our community and it is a high priority of the
County of Isle of Wight, Virginia; and,,
WHEREAS, the children who wait for families are not the babies
and toddlers traditionally associated with adoptions; rather, they
are children who are generally six years old and older; have
brothers or sisters with whom they need to be placed; and/or have.
a black, biracial, or-other minority heritage; and,
WHEREAS, .some have physical,. mental or emotional needs that
require special parenting skills and-who may have suffered neglect
and abuse in their early lives, having never known the security
and stability of a secure family.
NOW, THEREFORE, BE IT RESOLVED, that the Isle of Wight
County Board of Supervisors does hereby recognize the month of
November as Adoption Month in recognition of the need to promote
adoption opportunities for these children.

County Attorney Crook informed the Board the material received
was not acceptable and that he had submitted suggestions to the
Planning Department.
Supervisor Edwards stated that during budget deliberations,
the Board discussed the possibility of lowering the tax rate after
the final figures for the budget. were submitted. Supervisor
Edwards asked when would the County Administrator would be able to
report back to the Board on what kind of revenue is anticipated.
County Administrator Standish replied he would not be able to
report back to the Board until after the Equalization Board meets,
but at this point he did not see any foreseeable change in the tax
rate.
