Byrum, Assistant County Administrator Betty Scott, Secretary Chairman Bradby .called the meeting to order at 7:05 P.M. and stated this is a joint meeting with the Planning Commission and the Isle of Wight County Public Service Authority to review an up-date on the Isle of Wight County Master Water and Wastewater Service Plan. The Chairman also recognized the members of the Planning Commission, ..George F. Walls, Francis S. Griffin, George Winslow, Thomas A. Caldwell, Lottie Little, C. Fred Bailey and Hollis Herring, and members of the. Isle of Wight County"Public Service Authority, R. L. Thompson, J. A.. Spivey, John F. Wynne and Richard L. Turner The Chairman introduced Garland Page, representative of W. C. Overman Associates, P. C., the firm conducting the Isle of Wight County Master Water and Wastewater Service Plan. Mr. Page introduced Sandra Wier, project planner, with W. C. Overman Associates.. Mr. Page stated they would like to continue a discussion which began at the Planning Commission on February 26, 1987 and gave a presentation on the inventory and analysis phase on the water and wastewater plan. He continued stating the discussion tonight will be recommendations on the goals anal policy for same. Mr. Page also stated there will be another discussion at a later time .relative to the phase III option for the water and wastewater plan. Mr. Page continued say- ing the following County goals and policies for water and wastewater service are recommended L-or adoption to the Board of Supervisors, the Planning Commission,. April 29 19.$7 Page 277 the Public Service Authority, affiliated agencies and the public, as appropriate; Lsle of Wight County through its Public Service Authority will ensure the pro- vision of water and wastewater service while preserving environmental quality and. encouraging the desired land use patterns for the County, General goals that apply to both water and wastewater service are stated first, specific goals for water service and wastewater service follow the general goals and finally goals are presented for related governmental. functions such as the comprehensive p arming process, said Mr. Page. Mr, Page gave the .following general goal and policies: (1) The Public Ser- vice Authority (_PSA.) of Isle of Wight County will be the owner and administrator of all public water and sewer systems in Isle of Wight County outside. of the franchise areas of the systems belonging to the Towns of Srmithfield and Windsor and the City of Fzankli.n, The Public Service Authority will be supported by the County as necessary to carry out i,ts respeansiblities. (2) Isle of tiaght County through the PS,A will ender into regional agreements for the delivezy of water and wastewater services whenever. such agreements are in the best interest of the prospective customers, (3) The Isle of Wight County Board. of Supervisors endorses the Hampton Roads Water t~ualty Management Plan as updated in 1983. Sandra Wier discussed the water supply goals and policies as follows: (1. Isle of Wight County will make the best use of available iaater resources, Ground- water will generally be the source used to serve new customers in Isle of Wight County during the first phase,. The PSA-will cooperate with. the. S ate Water Control Board and the Department of Health i.n regulating this source.., The County will continue to regulate new wells by means of its zoning ordinance,-as amended. Local supplies of surface water will be considered as water sources during the second phase, A preliminary review indicates that a large, new reservoir entirely i.n Isle of Wight County would not be recommended, However, local supplies might. include such. sources as the. reservoirs thaw. serve Suffolk, particularly since they are. located partly in Isle of Wight County and the County should cooperate in the development of .the reservoirs In the final phase, Isle of Wight County will participate with. a11. of Southeast Virginia in agreements .for a regional solution to water supply. It may be the Lake Gaston pipeline. Isle of Wight County will initiate discussions with Virginia Beach to consider attaining water supply capacity for the County in the pipeline. project, (2) Tsle of Wight .County will develop a groundwater: protection. program. The County wi l prevent degradation of high quality of its groundwater resource, The County will identify .all agri- April 29, 1..9.87 Pae 278 cultural areas, local businesses and industries producing toxic wastes, road salt storage facilities and peroleum storage facilities capable of polluting groundwater recharge areas and wells. (3) Isle of Wight County will develop a water conservation program t4 be implemented during periods of drought, The County will institute a mandatory water conservation program following the Governor of Virginiats declaration of extreme drought, The County will continue its current water arrangements with Virginia Beach.. (4) Wherever-the PSA is providing a public water supply, lire protection standards developed by the ISO Commercial Risk Services, Inc,. will be used £or the water systems. Developers constructing waterworks systems must make adequate provisions for fire protection, Ms, Wier continued discussing the wasterwater goals and policies,.. (1) The Isle of Wight County PSA will provide cost.. effective centralized wastewater systems. to attract future suburban development including a balance of residential, commercial and. industrial land uses. Large central wastewater treatment facilities will serve densely populated areas near Smithfield, Windsor and Franklin. The County, through the PSA, will develop any PSA facilities in a way that best complements adjacent municipal systems,: The County may designate growth areas outside those areas .that can. be served reasonably by municipal systems. In- dependent central systems may be considered to be appropriate in those areas, (2) Isle of Wight County will retain current wastewater practices in any rural areas of the County that are not designated growth areas. Mr. Page discussed related County goals. (1) Isle `of Wight County will up- date its Comprehensive plan; the Master Water and Sewer Plan is the first element of the Comprehensive plan to be;"completed.: Lsle of:avight County's comprehensive plan update will include the -principal set of goals, policies anal recommendations for development of the County. The zoning ordinance regulations for certain residential districts will be modified in accordance with land use objectives for those districts in this plan. Provide a framework for maintaining and en- hancing the quality of existing neighborhoods by planning for orderly growth. Designate suburban development areas for maximum clustering of development and promote efficient service delivery. Buffer agricultural and forestal areas from suburban.. encroachment. (2) Isle,of Wight County will protect and enhance the quality of the. environment, The Board.Qf Supervisors will amend the sub- division and zoning ordinances to require that the rules and regulations and construction specifications and standards for water and sewerage facilities adopted by the Isle of Wight County Service Authority must be followed by developers April 29, 1987 Page 279 of residential. subdivisions and mobile home parks, industrial projects, com- mercial projects and other uses. Minimize erosion and sedimentation through improved implementation of the erosion and sedimentation control ordinance. The County subdivision ordinance .shall require installation of stormwater manage- merit facilities in all subdivisions, Installation of curbs and gutters in exist- ing subdivisions shall be the responsibility of property owners, County Attorney Crook questioned whether the consultants were advocating amending the subdivision ordinance to require curb.. and gutters. to which Ms. Wier replied could-be Swale not necessarily curb and gutter. (3) Isle of Wight County will retain agricultural lands in active product- ion. Isle of Wight County will continue to support use-value taxation. (,4) The Isle ;of Wight County Board of Supervisors will encourage the economic develop- merit of the County.. Isle of Wight County will .assure the provision of water and. sewer service to designated industrial areas, The low. cost and availability of watex and sewer service will be a part of a marketing. strategy to attract business and industry to the County. Isle of Wight County will continue to sup- port old and attract new industries that diversify the regional economy, Isle of Wight County will support agriculture and agriculturally related businesses. // County Attorney Crook. requested an executive session for the Board of Supervisors to discuss with staff members and legal counsel negotiations on intergovernmental agrQements and property acquisition for public use to be held later in the meeting, // Supervisor Bailey informed the Board members Grace Keen, Chairman of the Berms Church Historical Zone Beautification project, had contacted him about making another effort on behalf of the committee for the beautification of Berms Church intersection to obtain. contributions for shrubbery to landscape the intersection. Supervisor Bailey stated Mrs. Keen planned to send out letters requesting contributions and was asking the. Board to pay for the postage, which she estimates to be approximately $40.00 , Supervisor Turner made the motion the County provide up to $40.,00 far postage and the money be taken from the Contingency Fund. The motion was passed unanimously. // 0n motion of Supervisor Turner, the: Board voted unanimously to go into executive session to discuss with legal counsel and staff members negotiations `~ April 29, 1987 Page 280 on intergovernmental agreements and property acquisition for public use as re- quested by Mr. Crook. The Board went into executive session at 8:38 P.M. and returned to open session at 9:08 P.M, I/ Deputy Sheriff, Wes Garrett, addressed the Board about the possible need for a permit for the Fraternal Order of Police to hold a circus on the Smith- field High School property. Deputy Garrett stated this event had been planned. for sometime and many tickets had been sold and he was unaware a permit was needed. He said the Building Official, after seeing the information in the news- paper about the circus, called the Shexiff's,Office to advise them that the building code required an inspection by his office and that a permit might be required by the County. Deputy Garrett stated he had read provisions of the ordinance and stated he did not interpret that as requiring a permit. County Attorney Crook stated the ordinance was broader than what Mr. Garrett throught and Mr. Garrett should have sought advice from the County zoning office or from him before proceeding to this point. Mr. Crook read from the ordinance and stated the purpose of the ordinance was for protection of the health, safety and welfare of the citizens of the County and certain pro- cedures should be followed and approvals obtained to comply with the ordinance. The major problem, Mr. Crook stated, was that the ordinance required a public. hearing before the Board could grant a permit. In response to Supervisor Turner's question about whether some form of notification, such as radio, would be permissible, County Attorney Crook advised that the notice would have to be in a newspaper advertisement before the May 3, 1987 circus date, the Board could not grant the permit. County Attorney Crook suggested that Mr. Garrett get the proper forms and instructions from the Zoning Administrator and have those com- pleted so that approvals could be obtained from all agencies necessary and from the adjacent property owners. He also reminded Mr. Garrett that inspections would be performed by the Building Official in accordance with the requirements of the Building Code. County Attorney Crook emphasized that this still would not allow the County to grant a permit and that any adjoining property owner could seek to have the circus stopped because a permit had not been issued. How- ever, it would indicate measures had been taken to provide for the health, safety and welfare of the community. ~/ Supervisor Ross made a motion the meeting be adjourned. Byrum, Assistant County Administrator Betty Scott, Secretary Chairman Bradby called the meeting to order at 2:05. P.M. and delivered the invocation. // R. W. Coates, Resident Engineer, Department of Highways and Transportation, advised the Board members the resolutions to expend the remaining revenue shar- ing funds ($37,500) to level the abandoned railroad bumps on Routes 619, 641 and 632 had been prepared and given to County Attorney Crook for .review. .County Attorney Crook stated the resolutions were in order and he recommended them for adoption, with the correction of the misspelled word "rand". Supervisor Bailey moved. the Board adopt the resolutions to expend the remaining revenue sharing. funds ($37,500) to level the abandoned railroad bumps on Routes 619., 641 and 632 as corrected.. The motion passed unanimously. RESOLUTION Allocation of ,Revenue Sharing for Roads On motion of C. Fred Bailey, the following Resolution was adopted by unanimous vote. WHEREAS, Section 33.1-75-1 of the Code of Virginia provides that when a County designates a sum, not exceeding 15 percent of the County's Revenue Sharing Funds, for use by the Highway. and Transportation Board, for the contraction, maintenance, or improvement of secondary roads in such County that the Highway Board shall match such Revenue Sharing Funds as first priority allocation: NOW, THEREFORE, BE IT RESOLVED, that the Isle of Wight County Board of Supervisors hereby designates $37,500 of its Revenue Sharing Funds or General Funds for use ir_ the construction, main- tenance or improvement of secondary rods in the County of Isle of Wight, Virginia, to wit, State Route 619 (Budget Item Project
