Turner, Chairman C. Fred Bailey Joel C. Bradshaw, Jr. Thomas L. Ross, Vice Chairman Also attending: H. Woodrow Crook, Jr., County Attorney W. B. Owen,. County Administrator Juanita L. Byrum, Assistant County Administrator Betty Scott, Secretary Chairman Turner called the meeting to order at 7:25 P.M. The invocat- ion was delivered by Supervisor Bradshaw. /~ The Chairman stated the Paul Sawyer Family and attorney were present, along with Ronald H. Pack, Chairman of the Hampton Roads Sports Authority and moved the agenda be amended to discuss the proposed speedway lease agreement first. The motion passed unanimously. Mr. Pack said the talks between the Sawyers and the Supervisors, the first direct negotiations between the groups, came after several days of negotiations between. the Sawyers and the Executive Board of the Regional Sports Authority. He continued stating the City Managers and County Ad- ministrator of jurisdictions who make up the Sports Authority will be given their first look Wednesday at a lease agreement for the track. Mr. Pack stated he was not at liberty to give any details of the pact which was negotiated Monday afternoon and he doubted a copy of the lease would ever be made public. Edward Russell, attorney for the Paul Sawyer Family, advised the Board members the racing promoters would like a period of several years at the start of the contract when no payment would be made because the Sawyers need about $7 milliongross annually to be profitable and. the two races August 25, 1986 Page 53 will bring in less than that. The Sawyers are trying to attract other races to the facility, stated Mr, Russell. Mr, Russell continued stating his clients are strongly opposed to the amusement tax proposed on tickets anti if the tax-would be imposed the Sawyers were not interested. in promoting the proposed race track. The 70,000 seat track will be owned by the Hampton Roads Sports Authority, and therefore, will be exempt from real estate tax, commented Ron Pack. Chairman Turner stated the Authority members thought the County should be compensated and asked the Board to negotiate directly with the Sawyer Family. The Chairman stated the Tidewater cities would benefit from money spent by racing fans at motels and restaurants and most of Isle of Wight's revenue would come from taxes because there are few motels and restaurants in the County. Chairman Turner inquired of County Attorney Crook if it would be legal to go into Executive Session to discuss compensation to be paid the County by the Sawyers. County Attorney Crook replied it would be legal to hold. contract negotiations in Executive Session, but not to discuss taxes. Following discussion,. Supervisor Bradshaw moved the Board go .into Executive Session to discuss with legal counsel and staff members the pro- posed contracts regarding the speedway and asked that Ronald Pack. be ailawed to attend- the Executive Session since he is Chairman of the Hampton Roads. Sports Authority. John Edwards, of The Times, and Steve Wingfield, of The Daily Press, expressed objection to the closed door meeting. Mr, Wingfield asked County Attorney, H. Woodrow Crook, Jr,, to cite the Code section and subparagraphs to allow the Executive Session. County Attorney Crook replied Section 2,1- 344 sub-paragraphs A 2, 4, 6. The. motion passed ..unanimously to go into Executive Session with legal counsel to discuss contracts,. The Board went into Executive Session. at 7.:52 P.M, and returned to open session at 9:44 P.M. Chairman Turner moved the Board adopt a concept of contract with P, W. B. Promotions,.-Inc, so the County would be compensated .from P, W, B, Pro- motions, Inc. on the same basis as if the facility were a privately owned operation in the County, The vote in favor was unanimous. // At 9:45 P.M. Chairman Turner moved to have a ten minute recess and the motion passed unanimously. Supervisor Ross informed the Board members the Building and Grounds Committee had met with the Carrsville Volunteer Fire Department Building Committee anal they would .like the Boards approval. to advertise for architec-tural services. On motion of Supervisor Ross, the Board. unanimously authorized the advertisement for.axchitectural ser--vices for the Carrsville Volunteer Fire Department Building. Supervisor Bradshaw moved the Board approve the request of Public Works Director, Donald Bernd, to transfer $9.,300 from the Contingency Fund to line item 4204-3004 to rebuild the under carriage on the D-6 bulldozer, The motion passed unanimously. l/ Chairman Turner suggested Otelia Rainey. meet with the Public Service Authority and ask. far their consideration under the unusual case category re- lative to being able to tap on the water line in Camptown. /~ Supervisor Ross expressed concern regarding the approval of the water systems for subdivision by the fire departments., as well as the Health Depart- menu.. County Attorney Crook stated the fire department could give recommendat- ions, but not have final word. :~ L~ August 25, 1986 Page 57 // Supervisor Bailey moved the following members be appointed to the com- mittee to further study the proposed "Ordinance To Amend The Subdivision Ordinance Of Isle of Wight. County for Interior Streets and Other Require- merits For Lots Fronting On Arterial Roads, High. Service. Secondary Roads and Low Service Secondary Roads": George Winslow and Francis Griffin., Planning. Commission; Ballard Wood; Thomas L. Ross, Board of Supervisors; and Charlie Powell, Historial Review Committee, The motion passed by unanimous vote of the Board. Additional members will be selected at the September 4, 1986 Board meeting. On motion of Supervisor Ross, the Board voted unanimously to retain The Zoning Ordinance Of Tsle of Wight County Concernng'Number of Dwellings On Land" in the present form. Regarding the 40 hour work week, Supervisor Ross advised the Board members the Personnel Committee had sought information from other counties and cities in the area. about their work schedule and found the majority worked from 9:00 A.M. to 5:00 P,M, Supervisor Ross continued stating the Board has no control over the employees of the Constitutional Officers at the Courthouse who work 9:00 A.M. to 5:00 P.r1. and asking the Board's employees to work. longer hours than those in nearby departments would create a morale problem, Supervisor Ross further stated a major factor in the committee's recommendat- ion is the lack of lunchroom facilities at the Courthouse Complex; it is about 10 miles to restaurants in either Smithfield or Windsor and the employees must either take about 45 minutes to an hour for lunch out or eat at their desks, often continuing their work chores, TJhile the committee is not approving .the 35 to 37 hour work week, we are recommending keeping the current schedule until there are facilities for employees to take a lunch break away from their desks, Mr. Ross stated. Supervisor`Bailey expressed concern stating he was not satisfied with the committee's report; "nobody knows how many hours anyone is working. out here. Either adjust the schedule or the pay scale". Supervisor Bailey .further.: stated it is not up to the Supervisors to give employees a place to eat and the workers knew what facilities were available when they were hired. Following discussion, Supervisor Ross moved the County employees continue to work 9:00 A,M. to 5:.00 P.M, with an hour for lunch. Supervisor Ross delivered the invocation. ~~ Supervisor Bailey expressed concern relative to the widening of Routes 258 and 460 (right-of-way) in Windsor, R. W. Coates, Resident Engineer, Department of Highways and Transporta_t- ion, informed the Board members the Highway Department is in the process of studying the corridor and have contacted the owner of the Windsor Manoz Mobile Home Park. Mr, Coates said the Department should know something within six to ten weeks, but he does not know what the median design will be nor has he any idea about the funding and further stated any secondary work will have to come out of hte "Six Year Plan`' funds. Planning Director, Terry D. Lewis, informed the .Board members he had re- ceved a letter from Mr, Coates relative to Department of Highways and Transportation personnel the mobile hdme park streets for the County. Mr. Coates stated they do not have the personnel. to actually inspect the streets, but it might be possible the Department could periodically inspect the streets
