BOARD ROOM OF THE ISLE OF WIGHT COUNTY COURTHOUSE LOCATED AT 17090 MONUMENT CIRCLE, ISLE OF WIGHT, VIRGINIA ON THURSDAY, THE THIRD DAY OF MARCH IN THE YEAR TWO THOUSAND AND TWENTY-TWO PRESENT: Rudolph Jefferson, District 3, Chairman William M. Robertson, Assistant County Administrator Carey Mills Storm, Clerk CALL TO ORDER Chairman Jefferson called the work session to order at 6:00 p.m. INVOCATION Assistant County Administrator Robertson delivered the invocation and led the Pledge of Allegiance. APPROVAL OF AGENDA Supervisor McCarty moved that the agenda be approved as presented. The motion was adopted (5-0) with Supervisors Jefferson, McCarty, Acree, Grice and Rosie voting in favor of the motion and no Supervisors voting against the motion. PUBLIC HEARINGS A. Ordinance to Amend and Reenact the Isle of Wight County Code by Amending and Reenacting Chapter 5. Elections Caleb Kitchen, Chairman, Electoral Board, advised the Board that the largest move of voters had occurred in District 2 (formerly the Newport District) in the original section of Eagle Harbor, resulting in the Eagle Harbor Apartments and Bridgeport being moved to Bartlett. He further advised that due to facility and roof concerns at the Beaver Dam Baptist Church, he is requesting that the Board adopt an amendment to Section 5-11, Subsection (E) changing Beaver Dam Baptist Church to VFW Post 4411. 1 r w Chairman Jefferson opened the public hearing and called for persons to speak in favor or in opposition to the proposed ordinance. Herb DeGroft of Mill Swamp Road requested a seven-district study be undertaken as the Hardy and Newport districts may be contiguous but are not compact. Chairman Jefferson closed the public hearing and called for comments from the Board. Supervisor McCarty advised that a six-district plan had been crafted by Mr. Kitchen with a majority/minority status in District 3 and which required going out to Carrollton in order to achieve the 50% number for the minority community. He advised that Mr. Kitchen had also created a seven-district plan, but that he had been unsuccessful in creating a second majority/minority district. He added that a six-district plan with only one majority/minority district creates a retrogression which is not acceptable by the courts. Mr. Kitchen advised that he did not believe a six-district plan would have been perceived as acceptable because a five-voting district can be maintained. He further advised that the State Supreme Court, at the end of December 2021, had issued the congressional, State Senate and House of Delegates' lines and that the congressional and State Senate lines incorporate the entire County and the House of Delegates split the County from north to south using the old Windsor District line. He advised that the Supreme Court had held a public comment period and that several County residents, to include himself, had provided on-line comments. Supervisor Rosie moved to amend the Ordinance to Amend and Reenact the Isle of Wight County Code by Amending and Reenacting Chapter 5, Elections, in Section 5- 11, Enumerated. Section (e) District 5, Election District, Section (c) Beaver Dam precinct polling place and change Beaver Dam Baptist Church to VFW Post 4411 at 3385 Beaver Dam Road, Franklin, VA 23851. The motion was adopted (5-0) with Supervisors Jefferson, McCarty,Acree, Grice and Rosie voting in favor of the motion and no Supervisors voting against the motion. Supervisor Rosie moved that the following Ordinance be adopted as amended: ORDINANCE TO AMEND AND REENACT THE ISLE OF WIGHT COUNTY CODE BY AMENDING AND REENACTING CHAPTER 5. ELECTIONS. WHEREAS, Article 1, Section 2 of the United States Constitution mandates that a full accounting of all United States citizens take place every ten (10) years; and WHEREAS, Article VII, Section 5 of the Virginia Constitution and Section 24.1-304.1 of the Code of Virginia, 1950, as amended, requires Isle of Wight County in 2021 to reapportion representation among its election districts; and WHEREAS, Article VII, Section 5 of the Virginia Constitution and Section 24.1-304.1 of the Code of Virginia, 1950, as amended, requires that such districts shall be composed of contiguous and compact territory and shall be so constituted as to give, as nearly as is practicable, representation in proportion to the population of the district; and 2 WHEREAS, §24.1-304.1 of the Code of Virginia, 1950, as amended, requires Isle of Wight County to use the most recent decennial population figures for the County from the United States Bureau of the Census in the reapportionment of such districts; and WHEREAS, the 2020 decennial census indicated a 9.5% increase in Isle of Wight County's population, which required the County to adjust its voting districts in conformance with the requirements of the Constitutions of the United States and Virginia, as well as state and federal law; and WHEREAS, the Isle of Wight County Board of Supervisors did make such adjustments to its voting districts; WHEREAS, following such adjustments, the Virginia Supreme Court approved the voting districts for the Senate of Virginia, the Virginia House of Delegates and for Virginia's representatives to the United States House of Representatives; and WHEREAS, §24.2-304.1 of the Code of Virginia, 1950, as amended, authorizes localities to make adjustments to district boundaries in order that the boundaries might coincide with state legislative or congressional district boundaries; and WHEREAS, the new voting districts require the County to adopt and provide for the necessary voting precincts and polling places; and WHEREAS, it has been determined that the voting district numbers previously adopted to identify the districts was in conflict with the numbering system currently implemented by the Voter Registrar and that the voting districts should be renamed. NOW, THEREFORE, BE IT ORDAINED by the Isle of Wight County Board of Supervisors, Virginia, that the following sections of Chapter 5. Elections. are hereby amended and reenacted as follows: Sec. 5-7. Enumerated. The election districts with populations set forth are as follows: District 1 7929 District 2 8058 District 3 7443 District 4 7782 District 5 7583 (6-24-71, § 2; 5-20-81, § 2; 5-3-01, § 2; Ord. An Ordinance to Impose Tangible Personal Property Tax Rates for Isle of Wight County, Virginia for Fiscal Year July 1, 2022 through June 30, 2023 Gerald H. Gwaltney, Commissioner of Revenue, provided a recap of the Board's February 17, 2022 meeting in which he had presented preliminary data relating to the increase in personal property values and its impact on taxpayers. He advised that final forecasted values are now available including business personal property. He recommended that the personal property tax rate be reduced from $4.50 to $3.90 and that a car tax relief percentage of 35% be adopted. He advised the benefits to doing so would provide a tax relief on all vehicles; it would be business friendly; business vehicles would receive relief.since vehicles do not receive State car tax relief; business equipment tax is also lowered; and the County would no longer have the highest regional personal property tax rate. 23 • f Chairman Jefferson opened the public hearing and called for those to speak in favor of or in opposition to the proposed ordinance. No one appeared and spoke. Chairman Jefferson closed the public hearing and called for comments from the Board. Supervisor Rosie commented that the Board's number one priority is its citizens. He stated taking action to lower the Personal Property tax rate reflects who the Board is. Supervisor Acree commented that this is an opportunity for the Board to return money to its citizens with the expectation that when the County actually needs it, citizens will be more receptive. Supervisor McCarty remarked that this effort is a measure to mitigate the impacts on a temporary basis for rising costs. He stated that to his knowledge, the County is the only locality considering lowering its Personal Property tax rate. He stated that the Board values its citizens and lowering the personal property tax sends a positive message. Chairman Jefferson acknowledged the Commissioner of the Revenue, the Director of Budget and Finance and County Administrator Keaton for their actions of bringing this matter to the Board's attention. Supervisor McCarty moved that the following Ordinance reducing the Personal Property tax rate from $4.50 to $3.90 and adopting the car tax relief percentage of 35% be adopted: AN ORDINANCE TO IMPOSE TANGIBLE PERSONAL PROPERTY TAX RATES FOR ISLE OF WIGHT COUNTY, VIRGINIA FOR FISCAL YEAR JULY 1, 2022 THROUGH JUNE 30, 2023 BE IT AND IT IS HEREBY ORDAINED by the Board of Supervisors of the County of Isle of Wight, Virginia, to-wit: Section 1: That there is hereby levied for the fiscal year beginning July 1, 2022, a tax of $3.90 per one hundred dollars of assessed valuation on all tangible personal property, as defined and classified in Sections 58.1- 3500 through 3504 and Section 58.1-3506 of the Code of Virginia (1950, as amended) except that all household goods and personal effects as defined and classified in Section 58.1-3504 are exempt from said levy. Section 2: That, in accordance with the Personal Property Tax Relief Act, as adopted by the Virginia General Assembly, the car tax relief for Calendar Year 2022 shall be set at thirty-five percent(35%) for vehicles over $1,000 in value on the first $20,000.00 in value and for vehicles 24 v valued at $1,000.00, or under, the percentage of relief shall be one hundred percent (100%). BE IT FURTHER ORDAINED that this Ordinance be entered in the Minutes of this Board of Supervisors and that a copy thereof by the Clerk of this Board, be furnished to the Treasurer of this County. The motion was adopted (5-0) with Supervisors Jefferson, McCarty, Acree, Grice and Rosie voting in favor of the motion and no Supervisors voting against the motion. COUNTY ADMINISTRATOR'S REPORT No report was offered. UNFINISHED/OLD BUSINESS Amy Ring, Director of Community Development, brought the Board up-to-date on the request for a height exception for Heritage Apartments. She stated pursuant to the Board's direction at its January 17, 2022 meeting, the apartment builder owner and the adjacent property owner did meet to discuss some of the adjacent property owners' privacy concerns. She continued that staff has developed the following recommended conditions for the Board's consideration: Privacy screens should be installed on the balcony sides facing the single-family homes of a design approved by the Zoning Administrator and a revised landscaping plan submitted by property owner to include trees with a minimum height of 20 feet at maturity to be planted adjacent to the rear property lines of lots 1-4 of the adjacent Carrollton Meadows subdivision, to be approved by the Zoning Administrator following review by the owners of lots 1-4, to address privacy concerns. Supervisor McCarty moved that the exception request be granted with the following conditions: 1. Privacy screens to be installed on the balcony sides facing the single-family homes on the adjacent property of a design approved by the zoning administrator following review by the owners of lots 1-4, to address privacy concerns. 2. A revised landscaping plan submitted by property owner to include trees with a minimum height of 25 feet at maturity and a minimum height of 12 feet at planting to be installed adjacent to the rear property lines of lots 1-4 of the adjacent Carrollton Meadows subdivision, to be approved by the zoning administrator following review by the owners of lots 1-4, to address privacy concerns. 3. No windows shall be allowed on the east side of the apartment building. The motion was adopted (3-2) with Supervisors McCarty, Grice and Jefferson voting in favor of the motion and Supervisors Acree and Rosie voting against the motion. 25 Responsive to the Board's action at its February 17, 2022 meeting, County Administrator Keaton presented a resolution approving a budget amendment for the 7% interim salary increase for Public Safety employees. Supervisor Acree moved that the following Resolution be adopted: RESOLUTION TO AMEND THE FY 2021-22 BUDGET AND APPROPRIATE FUNDING FOR INTERIM SALARY ADJUSTMENTS FOR PUBLIC SAFETY EMPLOYEES WHEREAS, the Board of Supervisors of the County of Isle of Wight, Virginia, at its regular meeting on February 17, 2022, adopted a motion to grant a 7% increase to public safety employees; and, WHEREAS, the Board of Supervisors desires to amend the FY 2021-2022 Operating Budget Sales Tax Revenue in the amount of$131,727; and, WHEREAS, the Board of Supervisors needs to appropriate $110,462 to the General Fund and $21,265 to the E911 Fund for the public safety employee salary adjustments. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of the County of Isle of Wight, Virginia that the FY 2021-2022 General Fund and E911 budget is hereby amended and funds appropriated in the amount of $131,727 for the salary adjustments. BE IT FURTHER RESOLVED that the County Administrator of Isle of Wight County, Virginia is authorized to make the appropriate accounting adjustments and to do all things necessary to give this resolution effect • The motion was adopted (5-0) with Supervisors Jefferson, McCarty, Acree, Grice and Rosie voting in favor of the motion and no Supervisors voting against the motion.
