Jones, Jr., County Attorney Amber Johnson, Deputy Clerk CALL TO ORDER Chairman Grice called the meeting to order at 5:00 p.m. APPROVAL OF AGENDA Supervisor Jefferson motioned to approve the agenda with the following amendments. The motion was unanimously adopted (5-0). New Business - Rushmere Fire Department Funding Request COVID -19 Update —to include schools/teachers CLOSED MEETING Pursuant to Section 2.2-3711(A) of the Code of Virginia, Supervisor McCarty motioned to move to closed session for the limited purpose of: (1) Consultation with legal counsel employed by the Board regarding specific legal matters requiring the provision of legal advice by such counsel regarding the statutory requirements of Virginia Code Sec. 15.2-1812, the acquisition and leasing of real property in the Town of Smithfield for the public purposes and the sale or leasing of publicly held property, subsection 8 (2) A discussion regarding the appointment of specific appointees to County boards, committee or authorities as set forth in the agenda, pursuant to subsection 1; and (3) A discussion regarding the performance of a specific County employees, namely the County Attorney, pursuant to subsection 1 The motion was unanimously adopted (5-0) Supervisor Jefferson motioned to return to open session. The motion was unanimously adopted (5-0). County Attorney Jones reminded the Board that in accordance with Section 2-10(G) of your Rules of Procedure, all those who participated in the closed meeting are reminded that all matters discussed in closed meeting are to remain confidential, as provided under the Virginia Freedom of Information Act, and that such matters as were discussed in closed meeting should not be acted upon or discussed in public by any participant unless and until a public, formal action of the Board of Supervisors is taken on that particular subject matter. Supervisor McCarty motioned to adopt the following resolution certifying the closed Meeting, the motion was unanimously adopted. CERTIFICATION OF CLOSED MEETING WHEREAS, the Board of Supervisors has convened a closed meeting on this date pursuant to an affirmative recorded vote and in accordance with the provisions of the Virginia Freedom of Information Act; and, WHEREAS, Section 2.23712(D) of the Code of Virginia requires a certification by this Board of Supervisors that such closed meeting was conducted in conformity with Virginia law; NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors here by certifies that, the best of each member's knowledge, (i) only public business matters lawfully exempted from open meeting requirements by Virginia law were discussed in the closed meeting with which this certification resolution applies, and (ii) only such public business matters as were identified in the motion convening the closed meeting were heard, discussed or considered by the Board of Supervisors. VOTE AYES: Grice, Rosie, Acree, McCarty, Jefferson NAYS: 0 ABSENT:0 INVOCATION Supervisor McCarty gave the invocation and lead the Pledge of Allegiance. CITIZENS' COMMENTS Albert Burckard made remarks regarding the historical landmarks in the area. CONSENT AGENDA Supervisor McCarty motioned to approve the Consent Agenda as presented. The motion was unanimously adopted (5-0). RESOLUTION TO APPRORIATE FUNDING FOR COUNTY FAIR RELATED ACTIVITIES. WHEREAS, on July 16, 2020, the Board of Supervisors of Isle of Wight County voted to cancel the 2020 Isle of Wight County Fair in order to protect the health, safety and welfare of the citizens of Isle of Wight County due to the outbreak of COVID-19; and, WHEREAS, the Board of Supervisors of Isle of Wight County recommend continuing with County Fair activities in 2021. NOW, THEREFORE, BE IT AND IT IS HEREBY RESOLVED by the Board of Supervisors if Isle of Wight County, Virginia that the FY2020-2021 Operating Budget is hereby amended to appropriate funds to County Fair activities from General Fund Contingency for nine thousand five hundred dollars ($9,500), and funds in the amount of thirty thousand four hundred dollars ($30,400) needs to be appropriated to the County Fair Fund to cover costs associated with 2021 County Fair activities. BE IT FURTHER RESOLVED that the County Administrator of Isle of Wight County, Virginia is authorized to make appropriate accounting adjustments and to do all things necessary to give this resolution effect. RESOLUTION TO APPRORIATE COST OF LIVING ADJUSTMENT FOR COUNTY EMPLOYEES. WHEREAS, the Board of Supervisors has Previously approved the FY2020-2021 Annual Operating Budget; and WHEREAS, it is recommended that, effective February 1, 2021, a two percent (2%) cost of living salary adjustment will be provided for all eligible employees who were hired on or before June 30, 2020; and, WHEREAS, it its further recommended that, effective July 1, 2021, a two percent (2%) cost of living salary adjustment will be provided for all eligible employees hired on or before July 1, 2020. NOW, THEREFORE, BE IT AND ITIS HEREBY RESOLVED that the Board of Supervisors of the Isle of Wight, Virginia approve and authorize a 2% cost of living salary adjustment for all employees effective February 1, 2021, as stated above. Minutes • October 1, 2020 • October 15, 2020 • October 23, 2020 • November 5, 2020 REGIONAL AND INTER-GOVERNMENATL REPORTS — Brief updates were given on the following: • Supervisor McCarty — Hampton Roads Transportation Planning Organization • Supervisor Jefferson — Western Tidewater Regional Jail • Supervisor Acree — Hampton Roads Planning District Commission • Supervisor Grice — CMR Program for the Schools Construction Project Mr. Keaton — Southeastern Public Service Authority APPOINTMENTS Supervisor McCarty motioned to reappoint Mark Brown to the Wetlands Board, representing the Newport District. The motion was unanimously adopted (5-0). Supervisor Jefferson motioned to reappoint Evelyn McCullough to the Senior Services of Southeastern Virginia. The motion was unanimously adopted (5-0). Supervisor Jefferson motioned to appoint Barbara Wiggins to the Commission on Aging representing the Hardy District. The motion was unanimously adopted (5-0). SPECIAL PRESENTATONS/APPERANCES Don Robertson gave an update on the current statistics of the COVID-19 Vaccine Rollout in the Western Tidewater District. Overall Covid-19 Count for Isle of Wight County: • There have been 2,520 reported cases. • There have been 107 hospitalizations. • Related 43 deaths. • Isle of Wight County is fifth in the region for vaccine doses administered by locality of residence. The State has created a preregistration system at vaccinate.virginia.gov and by phone 1- 877 -VAX -IN -VA (1-877-829-4682). Mr. Keaton addressed the concern for teachers' vaccinations. Approximately 500 teachers registered for the vaccination, however, is undetermined how many received the vaccine. Mr. Keaton also clarified that local Virginia Department of Health employees are employed by the state and not by Isle of Wight County. COUNTY ADMINISTRATOR'S REPORT Stephanie Humphries gave the Quarterly Financial Report for the 2nd Quarter of FY2020- 21. Through December 2020, the general fund revenues stand at 52% and general fund expenditures are at 48%. During the second quarter the CAFR and the audit was completed. Third Quarter will include budget season and transparency of the budget process. 4 Mr. Keaton explained the Government Finance Officers Association Distinguished Budget Presentation Award for the Fiscal year beginning July 1, 2020. This is the sixth year in a row the award has been presented to the County. H Don Robertson gave a Legislative update and discussed with the Board the 2021 General Assembly Session, highlighting House and Senate Bills of interest. • S131 170 — Tabled in House Appropriations. Would add Isle of Wight County to the list of localities under current law that are authorized to impose an additional local sales and use tax at a rate not to exceed one percent, with the revenue used only for capital projects for the construction or renovation of schools. House Appropriations Committee members and contacts for local Representatives will be made available on the County website so that citizens can reach out to assist in getting this bill back on the table. • SB 1389 — Passed Senate and House Finance. Requires sales, use, and transient occupancy taxes to be calculated based on the total charges or the total price paid by the consumer for accommodations. Revenues after distributions to K-12 education, transportation will be appropriated to the Virginia Tourism Authority to provide grants to promote tourism, Local governments, local and regional destination marketing organizations could qualify for grants. • SB1404 — Passed by Senate and House. Authorize SLAF awards for projects related to Chesapeake Bay (TMDL) requirements to consider total phosphorus reductions or total nitrogen reductions. Authorizes grants for eligible projects similar to what is already done with the Water Quality Improvement Fund. • SB 1309 — Passed by Senate and House. Authorizes grants from a local Stormwater Management Fund to be used for flood mitigation and protection measures that are part of a comprehensive flood mitigation and protection plan adopted by the locality, and requires such grants, where practicable, to prioritize projects that include nature -based practices. • HBI 801 — Passed the House and Senate. Doubles the current possible minimum fine for dumping or disposing of litter, trash, refuse or other specified items on public property or on private property without permission, raising the fine from $250 to $500. The maximum penalty will remain at $2,500. H Mr. Keaton gave an update of possible upgrades to the Old Circuit Court Clerk's Office. No action was needed at this time, staff is continuing to work with the Historical Society regarding possible uses. Mr. Keaton distributed the following matters of interest for the Board's information only, no action was needed. • Delinquent Tax Collections — January 2021 • Cash Position — December 2020 • Statement of Treasurers Accountability — December 2020 • Museum Report — January 2021 • Western Tidewater Free Clinic Correspondence UNFINISHED/OLD BUSINESS Supervisor Jefferson motioned to adopt the following resolution, initiating the process in relocating the confederate monument. The motion was unanimously adopted (5-0). A RESOLUTION DIRECTING THE RELOCATION OF THE CONFEDERATE MONUMENT LOCATED AT THE ENTRANCE OF THE ISLE OF WIGHT COUNTY COURTHOUSE COMPLEX, 17140 MONUMENT CIRCLE, ISLE OF WIGHT, VIRGINIA, 23397 AND THE SOLICITATION OF POSSIBLE RELOCATION SITES WHEREAS, Virginia Code § 15.2-1812 authorizes the governing bodies of Virginia counties and cities to remove, relocate, contextualize, or cover certain monuments and memorials; and WHEREAS, on September 3, 2020, the Board held a duly noticed public hearing on its intent to remove, relocate, contextualize, or cover the confederate monument located at the entrance of the Isle of Wight County Courthouse Complex, 17140 Monument Circle, Isle of Wight, Virginia, 23397 (the "Monument"); and WHEREAS, having held that hearing, it is the consensus of the Board that the Monument should be relocated; and WHEREAS, a site on private property in the southern part of the County has been identified as a possible relocation site, but in accordance with the requirements of Virginia Code § 15.2-1812, before a final decision is made on the site to which the Monument would be relocated, the Board must offer the monument to any museum, historical society, government, or military battlefield; NOW, THEREFORE, BE IT RESOLVED that the Isle of Wight County, Virginia Board of Supervisor will relocate the Monument; and BE IT FURTHER RESOLVED that the County Administrator shall promptly solicit proposals from museums, historical societies, governments, and military battlefields, and any other interested entities or individuals, as a potential relocation site, and 30 days after such solicitations, staff shall review any such proposals and provide the Board with an analysis of the merits of such proposals; and that appropriate steps be taken to include 0 the designation of a relocation site on the Board's agenda promptly, but no sooner than 30 days after the County Administrator solicits the proposals detailed above. Relocating the confederate monument to a private site is the second option recommended by the Task Force, the first option, which was relocation to the Windsor Cemetery, was denied by the Windsor Town Council. Mr. Keaton discussed potential renovations of the Board of Supervisors Room; no action was needed at this time. NEW BUSINESS Joshua Bateman, Principal Planner gave the report for the proposed Rushmere Village Center Master Study/Plan. The purpose of the study is to expand on the recommendations of the new Comprehensive Plan, the potential development in the area, and planned construction of public utilities in the Rushmere vicinity. The study/plan will identify and prioritize the needs of the Rushmere community and create a plan for implementing the community's shared approach for: (a) preserving and enhancing community assets; (b) attracting appropriate businesses and housing, and (c) instituting land use policies and development design criteria. The first step will be to create and distribute a survey to residents to identify their top concerns and preferences with respect to the future of the community. Responses will be used to formulate project goals, devise implementation strategies, and recommend development guidelines to inform future County actions and guide public and private investments. The report was for information only, no action was needed. H Mr. Jefferson discussed a budget request from the Rushmere Volunteer Fire Department. The Department is requesting that the Board consider providing $20,000 of the $40,000 needed to equip a new truck. After discussion, the request will go to the Fire and Rescue Association for consideration then return to the Board at a March meeting. Mr. McCarty motioned to adopt the proposed budget guidelines and budget calendar for the FY2021-22.
