03-01-2018 Work SessionWORK SESSION OF THE ISLE OF WIGHT COUNTY BOARD OF SUPERVISORS HELD IN THE ROBERT C. CLAUD, SR. BOARD ROOM OF THE ISLE OF WIGHT COUNTY COURTHOUSE ON THURSDAY, THE FIRST DAY OF MARCH IN THE YEAR TWO THOUSAND AND EIGHTEEN PRESENT: Rudolph Jefferson, Chairman, Hardy District Don G. Rosie, Il, Carrsville District Joel C. Acree, Windsor District Richard L. Grice, Smithfield District ABSENT: William M. McCarty, Vice -Chairman, Newport District ALSO IN ATTENDANCE: Mark C. Popovich, County Attorney Randy R. Keaton, County Administrator Donald T. Robertson, Assistant County Administrator Carey M. Storm, Clerk CALL TO ORDER Chairman Jefferson called the work session to order at 6:00 p.m. Supervisor Acree delivered the invocation and led the Pledge of Allegiance to the American Flag. In anticipation of the expiration of upcoming hunting leases for the Blackwater River property owned by the County, Pete Acker, Division of Game and Inland Fisheries, addressed the Board regarding the management of that property by that agency. Discussion by the Board related to the amount of revenue received currently on the property from leasing the property to hunt clubs ($16,000); that the State has the resources necessary to manage the property; liability; that leasing the land to the State would provide hunting and fishing by the greater citizenry rather than just a small group of individuals; and, that revenues need to be generated to offset operating costs associated with the property. The consensus of the Board was that Mr. Acker provide the County Administrator and Director of Parks & Recreation with a proposal for management of the Blackwater property by the State for the Board's consideration, keeping in mind that neighboring landowners have voiced a concern with hunting dogs. Donald Jennings, Director of Utilities, stated pursuant to the Board's discussion at its work session of October 19, 2017 regarding potential policy options to require and/or incentivize new water customers, the Code of Virginia does not currently allow the County to mandate water utility connections. He advised one option to have that authority would be for the County to form a Public Service Authority or request legislation to grant the County the ability to mandate connections. 1 Regarding incentives, he inquired if the Board desired to define a limit of time when the tap fee could be reduced? He stated currently we are subsidized by the general fund and tap fees are placed in the general fund and, therefore, a reduction in tap fees would result in an increase draw from the general fund. Mr. Jennings is to return with the following considerations for Ordinance change regarding water connections: 1.) Make usage (of water after tap is provided) clear requirement in Ordinance 2.) Allow all tap fees to be paid over time (with water bill) 3.) Determine what running records the Virginia Department of Health has for private wells. Get history county -wide. 4.) Number of customers in Newport Development Service District on wells where water is available 5.) Consider two approaches for incentives: a. Route 10 scenario - have time to assess/develop policy b. All users on existing lines that we are not sure we invited to tap 6.) Provide definition of Public Service Authority (legal steps plus steps to become an Authority.) 7.) Assess more realistic interest rate — suggested rates of 3 to 3.5 percent 8.) Provide some example incentives to connect a. Life cycle of well and pump b. Require mandatory use when parcel changes hands C. Consider a longer window to connect (extended window for reduced tap) Supervisor Acree requested a Fire Hydrant Maintenance Policy be developed and that metered hydrants be identified. Jeff Terwilliger is to bring this up to the Association of Fire Chiefs. County Attorney Popovich briefed the Board regarding proposed revisions to Isle of Wight Code Chapter 15, Taxation. The County Attorney is to provide a clean version to the Board for its review in anticipation of a public hearing at the Board's regular meeting in April of 2018. The County Attorney is to advertise a public hearing on proposed revisions to Chapter 12 - Miscellaneous Offenses at the same time as Chapter 15, Taxation, is advertised for public hearing. Staff is to check the County's authority to set time frames for shooting. A Resolution in Recognition of the Retirement of Sheriff Mark Marshall is to be placed on the Board's March 14, 2018 agenda.
